Prohibited Products Policy

1. Purpose

MustHave Essential operates a marketplace and requires Vendors to comply with applicable laws and marketplace safety requirements. This Prohibited Products Policy identifies categories of products that may not be listed, advertised, sold, or distributed through the MustHave Essential marketplace. MustHave Essential may remove products or restrict Vendors where we identify prohibited or high-risk listings.

2. Illegal Products

Vendors must not list products that are illegal to manufacture, possess, distribute, import, export, or sell under applicable law.

3. Counterfeit and Unauthorized Products

Prohibited: counterfeit goods, fake branded products, unauthorized replicas presented as genuine, products using trademarks without appropriate authorization, stolen goods, and products obtained through unlawful means. Vendors must be able to demonstrate authenticity or lawful sourcing where reasonably requested.

4. Weapons

Vendors must not list prohibited or unlawfully supplied weapons or weapon-related products. Products subject to licensing, registration, age restrictions, or other legal requirements may be restricted or prohibited depending on applicable law and marketplace requirements.

5. Illegal Drugs and Controlled Substances

Prohibited: illegal narcotics, unlawful controlled substances, products intended to facilitate illegal drug use, and other products prohibited by applicable law.

6. Prescription and Restricted Medicines

Prescription medicines and other restricted medical products may not be sold through the Platform unless MustHave Essential has expressly approved the category and the Vendor satisfies all applicable licensing and regulatory requirements.

7. Hazardous Materials

Vendors must not list unlawful or improperly handled hazardous substances, chemicals, explosives, or other dangerous materials. Products that require special transportation, storage, labelling, licensing, or regulatory approval may be subject to additional restrictions.

8. Tobacco and Nicotine Products

Tobacco, nicotine, vaping, and related products may be restricted or prohibited depending on applicable law, payment-provider requirements, age restrictions, and MustHave Essential's category rules.

9. Alcohol

Alcohol products may be subject to legal, licensing, age, delivery, payment-provider, and other restrictions. MustHave Essential may prohibit such products even where a Vendor believes that the product is legally available for sale.

10. Adult and Explicit Products

MustHave Essential may prohibit sexually explicit products, pornography, or products that violate applicable laws, payment-provider requirements, or marketplace standards.

11. Financial and Regulated Services

Vendors must not use the marketplace to provide unauthorized banking services, money-transfer services, stored-value services, investment services, securities, cryptocurrency financial services, or other regulated financial products.

12. Fraudulent or Deceptive Products

Products or listings must not make fraudulent claims, promise guaranteed financial returns, misrepresent health or financial benefits, use deceptive pricing, advertise fake discounts, or otherwise materially mislead Customers.

13. Stolen Property

Stolen property or products that a Vendor does not have the legal right to sell are prohibited.

14. Hazardous or Unsafe Consumer Products

MustHave Essential may remove products that present an unreasonable safety risk or that do not comply with applicable safety requirements. Vendors are responsible for ensuring that their products meet applicable safety standards.

15. Products Requiring Special Approval

Where a product requires a licence, registration, certification, government approval, professional authorization, or other regulatory documentation, the Vendor must provide appropriate evidence when requested.

16. Product Recalls

Vendors must promptly notify MustHave Essential if a listed product is recalled, subject to a safety warning, found to be defective, prohibited by a regulator, or otherwise determined to present a material consumer risk. MustHave Essential may immediately suspend the relevant listing.

17. Enforcement

MustHave Essential may remove a prohibited listing, suspend a Vendor, cancel affected orders, restrict marketplace access, withhold or adjust settlement where permitted, request additional documentation, report suspected unlawful activity where appropriate, or permanently terminate a Vendor account.

18. Vendor Responsibility

Vendors are responsible for ensuring that products they list comply with applicable laws and MustHave Essential's marketplace requirements. The fact that a product appears on the Platform does not constitute an assurance that the product is suitable, legal, safe, authentic, or compliant.

19. Policy Changes

MustHave Essential may add, remove, or modify prohibited categories as laws, payment-provider requirements, marketplace risks, or business policies change.
